China's Hu to meet Taiwan delegate at APEC

China's President Hu Jintao will meet with a senior Taiwanese politician here on Saturday, both sides said, expressing hopes the rare talks would see progress towards a trade agreement.

China's Commerce Minister Chen Deming confirmed the meeting between Hu and Taiwan delegate Lien Chan would take place on the sidelines of the Asia-Pacific Economic Cooperation (APEC) forum in Singapore.

"I believe tomorrow's meeting will be a productive one," he told a media briefing Friday, when asked whether he expected it to yield a breakthrough on the trade talks.

Lien said earlier he hoped the two sides could sign a proposed Economic Cooperation Framework Agreement (ECFA) "as soon as possible."

"We anticipate that we'll have a chance to seek (Hu's) views on these essentially important issues," he said of the meeting with the Chinese premier.

"We hope to complete the whole process by next year," said Lien, who served as the self-ruled island's vice president from 1996 to 2000.

"I don't anticipate any insurmountable obstacle in this regard."

APEC's full summit including Hu, US President Barack Obama and 19 other Pacific Rim leaders will be held on the weekend.

Hu and Lien, the honorary chairman of Taiwan's ruling Kuomintang party, met one-on-one at last year's APEC gathering in Peru amid a warming in ties brought about the 2008 election of China-friendly President Ma Ying-jeou.

It marked the highest-level overseas meeting between the former rivals since their split in 1949 after a civil war.

The economic agreement is seen as bringing the two sides closer to normalising and systemising their economic relations.

Taiwanese presidents are barred from APEC summits due to objections from China, which regards the island as part of its territory, and are usually represented by senior economic advisers or business leaders.

Madoff's former IT experts arrested over $65bn fraud

Former Bernard Madoff computer programmers have been arrested for allegedly helping fraudster hide Ponzi scheme

Two computer programmers who worked for fraudster Bernard Madoff were arrested today on charges of helping to cover up his $65bn swindle.

The US attorney's office in New York said that Jerome O'Hara and George Perez were arrested at their homes by the FBI. It said the pair formerly worked for Bernard L Madoff Investment Securities on the infamous 17th floor of his Manhattan offices from where he ran his scam.. They are charged with conspiracy, falsifying books and records of a broker-dealer, and falsifying books and records of an investment adviser.

The securities and exchange commission allege the defendants used their computer skills to produce false documents and trading records to hide the fraud. It is also alleged that they took bribes in return for their silence during their 20-year service for Madoff.

"Without the help of O'Hara and Perez, the Madoff fraud would not have been possible," said George Canellos, director of the SEC's New York office. "They used their special computer skills to create sophisticated, credible and entirely phony trading records that were critical to the success of Madoff's scheme."

The 71-year-old Madoff was sentenced in June to 150 years in prison for orchestrating a decades-long Ponzi scheme whereby investors were paid returns with cash from new clients.

According to the SEC's complaint, Madoff and his lieutenant Frank DiPascali routinely asked O'Hara and Perez for their help in creating records that combined actual positions with the fictional balances in investor accounts.

The SEC says O'Hara, 46, and Perez, 43, wrote programs that generated many thousands of pages of fake trade blotters, stock records, Depository Trust Corporation (DTC) reports and other phantom books and records to substantiate nonexistent trading. They assigned file names to many of these programs that began with "SPCL," which is short for "special."

The SEC alleges that O'Hara and Perez had a crisis of conscience in 2006 and tried to cover their tracks by attempting to delete approximately 218 of the 225 special programs. According to notes found in O'Hara's desk, one of them told Madoff, "I won't lie any longer. Next time, 'ask Frank,'" meaning Madoff should rely on DiPascali to create the false reports. But Madoff then told DiPascali to give the pair a salary increase of nearly 25% and bonuses of more than $60,000 each to keep them quiet. DiPascali has pleaded guilty to fraud, as has auditor David Friehling.

Katt Williams: Speaking Out on Arrest, Legal Drama Ensues

Updated 12:45 p.m., Nov. 13, 2009: It appears Katt Williams is still in search of some southern hospitality in the days following his release from jail. The Atlanta Journal-Constitution reports, the comedian has also been kicked out of his rented penthouse suite in Atlanta's Four Seasons hotel. Employees claimed Williams was causing a disturbance among other guests. "I haven't been here 72 hours and I'm being kicked out of the Four Seasons even though I paid up front and in cash," he said during a press conference on Thursday evening. "I don't understand. I'm at the point now where I'm standing out here with millions of dollars in movies and TV specials sold and most of them done right here in Atlanta. And to be ceremoniously dismissed at a hotel is sad."

Katt Williams made headlines over the weekend for an alleged burglary in which he's accused of taking nearly $4,000 worth of jewelry and collectible coins from a suburban Atlanta home, but another unrelated incident involving the comedian recently surfaced. A 17-year-old claims Williams held him and "threatened" to beat him up if he left the Newman, Ga., estate where Williams lives. Officials stated that the 'Wild 'N Out' star will not be charged for the incident. Check out the teen's 911 call here.

Black Coalition Calls Obama 'White Power in Blackface'

During one of his campaign stops last year, then-democratic candidate Barack Obama gave a rally speech that was interrupted by a group of hecklers holding up signs in the balcony of a college gymnasium.

Nothing seemed to be out of the ordinary until the television cameras focused on the group. They were black people shouting out anti-Obama slogans, holding up signs decrying Obama for, among other things, not being "down" with black people. I remember thinking what do they want black people to do? Vote for McCain and keep bitching?

So now, a group of brothers calling themselves the Black Is Back Coalition staged a demonstration declaring the president, "white power in blackface." I wonder if these are the same dudes in the gym who got quickly shuffled off by security.

The coalition said:

We recognize that Barack Hussein Obama is white power in blackface," civil rights activist Omali Yeshitela, chairman of the Black is Back coalition, which arranged the protest, called into a megaphone as the group marched outside the mansion's gates. "He is a tool of our imperialist enemies, and we demand our freedom. And we demand that Obama withdraw all the troops from Afghanistan right now.

I remember cats like this in college, whom we jokingly called the "blackness police." Their mission was to serve as a barometer of who was being black enough, as though there were a set of black standards and practices that all African Americans had to follow, lest they run the risk of being called out.

Napolitano Calls For Congressional Immigration Reform

The Obama administration has met many of the border security benchmarks Congress set in 2007 as a prerequisite to immigration reform and now it's time to change the law, Homeland Security Secretary Janet Napolitano said Friday.

Napolitano, designated by President Barack Obama to lead the administration's immigration reform efforts, said many members of Congress had said they could support immigration reform, but only after border security improved, Napolitano said.

"Fast forward to today, and many of the benchmarks these members of Congress set in 2007 have been met," she said in a speech to the Center for American Progress, a liberal think tank.

She cited construction of 600 miles of border fence and the hiring of more than 20,000 Border Patrol agents. Illegal immigration has also fallen sharply because of better enforcement and the economy.

"I've been dealing hands-on with immigration issues since 1993, so trust me: I know a major shift when I see one, and what I have seen makes reform far more attainable this time around," Napolitano said.

Congress passed tough immigration enforcement legislation in 2006 that called for building 700 miles of border fences and barriers. Immigration critics have said the fence has not been built with double layers as the law required and is not all fencing.

"How can they claim that enforcement is 'done' when there are more than 400 open miles of border with Mexico, hundreds of thousands of criminal and fugitive aliens and millions of illegal immigrants taking American jobs?" said Rep. Lamar Smith of Texas, the top Republican on a House immigration subcommittee.

Napolitano said the immigration and border security improvements are not enough. "The laws themselves need to be reformed," she said.

Obama has repeatedly said immigration reform is a priority, although it has been pushed further down the list as he has taken on the economy and health care reform.

Sen. Charles Schumer, D-N.Y., has said he would introduce legislation by early next year. New Jersey Sen. Bob Menendez, who heads the Senate Democrats' campaign arm, has said immigration reform must be done by March or it won't be taken up until after the 2010 elections.

Evangelist sentenced to 175 years for sex crimes

Evangelist Tony Alamo was sentenced Friday to 175 years in prison for taking underage girls across state lines for sex, effectively punishing him for the rest of his life for molesting children he took as "brides" in his ministry.

During Friday's hearing, some of Alamo's victims testified about how their families were destroyed while the evangelist took over their lives.

Alamo, 75, had been convicted in July on a 10-count federal indictment. U.S. District Judge Harry F. Barnes said Alamo used his status as father figure and pastor and threatened and threatened the girls with "the loss of their salvation."

"Mr. Alamo, one day you will face a higher a greater judge than me, may he have mercy on your soul," Barnes said.

Confusion between H1N1 and swine flu

We're writing this at an altitude of 20,000 feet, being on the road again and except for a few minutes here or there, without access to the internet most of the day. This means a lot of comments will probably go unanswered, so we'll say what we usually do in circumstances like this: talk amongst yourselves. Lots of smart people read this blog. Help each other.

A quick look at today's flu news tells me that CDC has updated its estimates, using the methodology we discussed in a previous post. And a survey at Arizona State University (ASU) released Monday shows the expected: that opting to call swine flu "H1N1" instead of swine flu has done nothing but confuse people. Predictable. Mrs. R. works in a health department and one of her colleagues was heard to say you could get H1N1 over and over again. He was wrong if he meant the swine flu H1N1 but quite correct if he meant H1N1 in general, because H1N1 is one of the seasonal flu subtypes that's been around since 1977 (and prior to 1957) and its antigenic drift every couple of years is the reason we have to change strains in the seasonal flu vaccine periodically. The confusion between seasonal H1N1 and swine flu H1N1 was quite evident in the ASU poll:

There was really no reason to change terminology from swine flu to H1N1 (the pandemic virus, after all, is composed of genetic pieces entirely of swine origin) -- no reason, that is, except to appease the pork industry and the national and intergovernmental agencies whose job is not public health but the promotion of agriculture. Promoting agriculture is a good thing (depending on the kind of agriculture, of course), but not at the expense of confusing people about public health.

So now there is handwringing in public health circles about public confusion. Some of it was inevitable. And some of it was avoidable.

FBI: Scott Rothstein's Ponzi Scheme Was $1 Billion

We now have a sense of how big south Florida lawyer Scott Rothstein's alleged Ponzi scheme may have been.

WSJ: An alleged Ponzi scheme by prominent Florida attorney Scott W. Rothstein likely topped $1 billion, the Federal Bureau of Investigation said Thursday.

Law-enforcement authorities are still gathering information on the massive suspected fraud, and criminal charges aren't likely to be filed for weeks, added a spokeswoman at the FBI's field office in Miami.

Earlier estimates were vague, with press reports usually saying "hundreds of millions of dollars;" the New York Times used $500 million. Clearly, this is much more.

Wire: Bomber Strikes Near US Military Base in Afghan Capital

WASHINGTON, Nov. 13, 2009 -- Newswire services this morning reported that Afghan officials say a suicide bomber struck a convoy of vehicles Friday near a U.S.-run NATO military base in Kabul, wounding six people.

The Taliban claimed responsibility for the bombing outside Camp Phoenix.

NATO said the wounded include civilian contractors, foreign soldiers and Afghan civilians.

VOA News noted that there have been a number of attacks targeting international operations in the Afghan capital in recent months, including an attack on a United Nations guesthouse and the Indian embassy.

This year has been the deadliest for international troops in Afghanistan since the fall of the Taliban-led government in 2001.

Also Friday, British Prime Minister Gordon Brown said he is urging military allies to contribute more forces to the NATO-led mission in Afghanistan. In an interview with the BBC, he expressed confidence that international partners could provide up to 5,000 additional troops.

Germany has pledged to send more than 100 extra soldiers to Afghanistan.

More than 4,000 German troops are in Afghanistan serving with NATO forces, with most based in the country's north.

Obama was due to talk to Netanyahu for 30 minutes, but the meeting actually went on for some 70 minutes. Is Obama telling Netanyahu that Hillary was, perhaps, overly generous to him when she was in Israel?

For the tone of Bill Burns had changed subtly but markedly from the one taken by Clinton, giving one the clear impression that a fair amount of walking back is taking place.

Burns: "We seek to create the best possible circumstances for negotiations, working with the parties, working with key regional partners like Egypt and the Quartet. We do not accept the legitimacy of continued Israeli settlements; we consider the Israeli offer to restrain settlement activity to be a potentially important step, but it obviously falls short of the continuing road map obligation for a full settlement freeze. We seek to deepen international support for the Palestinian Authority’s impressive plan to build over the next couple years the institutions that a responsible Palestinian state requires. And we also seek progress toward peace between Israel and Syria, and Israel and Lebanon, as part of a broader peace among Israel and all of its neighbors." (emphasis added)

Clinton's gaffe may very well have contributed to Abbas' decision not to seek re-election and the Obama team are giving every impression that they are now leaning back towards the Palestinians.

The Obama administration now seems to be trying to desperately signal to Abbas that it is trying to give him more to work with -- and hoping it is not too late."Almost everything cited here shows a subtle but noticeable shift back towards the Palestinian perspective," says the American Task Force for Palestine's Hussein Ibish.

I'm relieved that Obama is bringing this back from the brink. I thought Hillary's comments were crass. And I'm pleased to see Burns refer to a "continuing road map obligation" when referring to settlement freeze, rather than the Israeli take on this, that it is a Palestinian pre-negotiation demand.

Israel agreed to this when she signed up for the Road Map and Netanyahu is attempting to move the goalposts when he claims that to agree to a settlement freeze is to prejudge the negotiations.

SIRIUS Losing XM Founder (that everyone forgot) (SIRI)

SIRIUS XM Radio (NASDAQ: SIRI) announced that Gary Parsons has resigned as Chairman of the Board of Directors. The satellite radio giant has appointed Eddy Hartenstein, an independent director, to serve as non-executive chairman. An excerpt from Parsons’ farewell note was:

•“… we have begun to generate positive cash flow and have substantially improved our financial condition. While challenges remain, I’m confident that under the direction of Mel Karmazin and with the assistance of Eddy Hartenstein, SIRIUS XM will continue to grow and flourish.”
The sad thing is that Parsons was effectively forgotten about by most in the public. He was the founder and chairman of XM Satellite Radio before SIRIUS and XM merged.

Frankly, it does not seem that anyone cares. Karmazin and his team are in. Shares closed up 4.7% at $0.66 today and shares are up 1% in the after-hours session.

IS PEYTON-BRADY REALLY A RIVALRY?

I can appreciate that Peyton Manning and Tom Brady are both great NFL quarterbacks. They and their teams are the Stuffed Chicken Marsala and Tour of Italy of the NFL–perennially delicious and on the brain without so much of a glance at the other fare on the menu. They’re always good. And I understand that, yes, these teams have played each other every year since 2003 and occasionally meet in the playoffs. But does that really make Colts-Patriots a rivalry?

Merriam-Webster defines rival as simply, “one of two or more striving to reach or obtain something that only one can possess.” But doesn’t that apply to all 32 teams in the NFL? You know, besides the Browns? What makes this “rivalry” different. Well, aside from the fact that the Colts and Patriots shared a division until the 2002 season, not a whole hell of a lot.

The teams don’t exactly share similarities–the Patriots are a shrewd, defensive-minded team cast in the image of their maker/videographer Bill Belichick. The Foxboro defense relies on both exuberant team speed and sometimes parts discarded from other clubs. The Colts, conversely, let it all hang out, and are happy to let Pey-Pey lead the offense’s expeditions to the end zone and hope that the defense can keep up. It’s the same blueprint that the Saints have used in their own digs; when a team plays more than half their games in favorable climates, you can do that.

Don’t get me wrong, it’s going to be a badass game. But that’s all it is. There’s no turf war between Boston and Indianapolis, no bolstered competitiveness that can’t be found in any other game involving great teams. But when two of the league’s best get together on national TV, there’s doesn’t have to be.

LeBron James Announces He’s Changing Jersey Numbers from 23 to 6

LeBron James, the reigning MVP of the NBA, made a huge announcement Thursday night after the Cavs beat the Heat. He was so grateful for Michael Jordan coming to watch the game that he announced he would change jersey numbers from 23 to 6 starting next season. King James most likely chose the number to begin with because he wanted to emulate MJ, but now he’s evidently decided that nobody can touch Jordan, so nobody should wear his jersey number. If 23 hasn’t been retired league-wide, LBJ is starting that movement, so to speak. Anyway, here’s the video of LeBron James announcing he’s changing jersey numbers to 6, just skip ahead to around the 1:30 mark or so:



Many people will likely relate this story to what happened with Kobe Bryant who changed from jersey number 8 to jersey number 24. People often suggest that the reason a star player changes jersey numbers is to boost his personal jersey sales by giving existing fans a reason to buy another one. If you’re reading into things, you could conclude that this means LeBron is staying with the Cavs. Why is that? If he were going to sign with a new team, his new jersey would likely become the top seller in the NBA. If he stays with the Cavs, changing numbers would help boost his sales. Craig Sager tried to slip in that question at the end of the interview but LeBron didn’t bite. Too bad.

Need an abortion? Just work for the RNC

RNC’S INSURANCE PLAN COVER’S ELECTIVE ABORTIONS

Poor Michael Steele. The Republican National Committee chairman is less than a year into his term and he just can’t seem to get things right.

First, Steele got into a very public spat with conservative talk show host Rush Limbaugh. The he agreed that President Barack Obama is “the magic negro” and told GQ magazine that women have a “right to choose abortion.”

Steele also launched as awful RNC website last month and just this week came under fire for saying that white Republicans are afraid of black people.

And now, this:

The Republican National Committee’s health insurance plan covers elective abortion – a procedure the party’s own platform calls “a fundamental assault on innocent human life.”

Federal Election Commission Records show the RNC purchases its insurance from Cigna. Two sales agents for the company said that the RNC’s policy covers elective abortion. [...]

According to several Cigna employees, the insurer offers its customers the opportunity to opt out of abortion coverage – and the RNC did not choose to opt out. [The Politico]

Oh boy.

Steele’s team said the coverage predates his chairmanship, but they obviously haven’t changed the plan or switched providers.

Ironically, Steele gave a speech in Michigan Thursday saying that it’s important that the federal government doesn’t pay for abortions.

Steele, of course, narrowly defeated former South Carolina GOP Chairman Katon Dawson for the RNC post. He was aided in that effort by Palmetto State political consultant Jim Dkye.

Dyke was paid nearly $60,000 to get Steele elected, and unfortunately for the Republican Party, he recorded a rare victory in that race. And yes, that’s the same Jim Dyke who apparently goes after opponents by doctoring Facebook screen shots.

Daniel Radcliffe Allegedly Smokes Weed at London Party

Daniel Radcliffe looked “spaced out” as he reportedly smoked cannabis at a party.

Photographs have emerged of the ‘Harry Potter’ star appearing dazed and confused after apparently smoking a “joint” – a term commonly used to describe a cannabis-laced cigarette – at a recent London bash, where he boasted of his drug-taking and even let a girl draw a moustache on his face.

Fellow guest Wadia Tazi, 26, said, “He was really friendly and talking about his dad a bit. Then he pulled out a huge joint and lit up. Daniel said he loved it.

“Daniel was laughing and seemed to find it funny. But he didn’t really look like he knew what was going on. I was surprised by his behavior.

“He looked spaced out and away with the fairies.”

After giggling and chatting to other guests at the private bash, it has been reported the 20-year-old actor started telling everyone, “I love weed!”

However, Daniel was seemingly determined Wadia and his friend, who arrived at the party in the early hours of the morning, didn’t work out who he was.

Wadia explained to Britain’s Daily Mirror newspaper, “I didn’t recognize him as he looked so different to what I expected from the films. When my friend told me who he was, I was shocked.”

However, spirits dropped when a man called Sam, believed to be Daniel’s minder, realized the two guests had noticed his behavior and were possibly making recordings on their mobile phones.

The actor then made a swift exit from the party with his on/off girlfriend Laura O’Toole.

Wadia explained, “Laura was very protective. She said Daniel had a reputation to protect and couldn’t ruin it. I presume she meant by being seen smoking. I said I didn’t know what she was talking about. But almost immediately afterwards, she and Daniel left.”

Catholic Archdiocese In D.C. May Stop Social Service Programs Due To Gay Marriage Bill

The Catholic Archdiocese of Washington says it will likely discontinue its social service programs because a same-sex marriage bill approved by a committee in the D.C. Council this week would force them to provide services to gay couples.

The full Council is expected next month to vote in favor of the bill, and Mayor Adrian Fenty has said he will sign it.

The legislation introduced in October by Council member David Catania, an independent and chairman of the Health committee, was reported out with amendments by the Committee on Public Safety and the Judiciary on Tuesday. It does not require religious groups to participate in gay marriages, and exempts them from the “promotion of marriage through religious programs, counseling, courses, or retreats.”

The Archdiocese said the exemption, revised by the committee from “the promotion of marriage that is in violation of the entity’s religious beliefs,” is too narrow. It said it would become vulnerable to lawsuits if it refuses to promote gay marriages in its initiatives such as adoption services, programs for the poor and benefits for same-sex employees.

“It is our concern that the committee’s narrowing of the religious exemption language will cause the government to discontinue our long partnership with them and open up the agency to litigation and the use of resources to defend our religious beliefs rather than serve the poor,” said Edward Orzechowski, president/CEO of Catholic Charities of the Archdiocese.

Catholic Charities serves 68,000 people in the city annually apart from the thousands who rely on the 93 social programs provided by the 40 Catholic parishes in the District.

National gay advocacy groups had hailed the committee approval of the gay marriage bill. The Human Rights Campaign, the nation’s largest LGBT advocacy organization, has been rallying grassroots support for the measure, partnering with 200 members of the clergy in the District to hold an interfaith service in support of marriage equality.

The District earlier this year passed a measure recognizing same-sex marriages performed in other states. That bill was passed by a 12-1 vote of the Council.

The District already has a 1992 law allowing unmarried couples to register as domestic partners, but the statute only took effect in 2002 when Congress lifted a ban on using public money on the District’s domestic partner registry.

In September, a coalition of conservatives, including Bishops Harry Jackson and James Silver, filed a request with the District of Columbia Board of Elections for a ballot initiative next year that would define marriage as between a man and a woman. The initiative has the support of the Archdiocese.

Massachusetts and Connecticut were the first states to legalize same-sex marriages. Four states enacted legislation this year: Iowa, Vermont, Maine and New Hampshire. Main overturned its law this month in a referendum.

New York is set to vote on a bill before year’s end, while California may hold a referendum on whether to repeal Proposition 8, its ban on gay marriages.

Breaking: Khalid Sheikh Mohammad to Face Trial in NY Civilian Court

This has "terrible mistake" written all over it. The AP is reporting the news:

Self-proclaimed Sept. 11 mastermind Khalid Sheikh Mohammed and four other Guantanamo Bay detainees will be sent to New York to face trial in a civilian federal court, an Obama administration official said Friday.
The official said Attorney General Eric Holder plans to announce the decision later in the morning.

The official is not authorized to discuss the decision before the announcement, so spoke on condition of anonymity.

Bringing such notorious suspects to U.S. soil to face trial is a key step in President Barack Obama's plan to close the terror suspect detention center at Guantanamo Bay, Cuba. Obama initially planned to close the detention center by Jan. 22, but the administration is no longer expected to meet that deadline.

It is also a major legal and political test of Obama's overall approach to terrorism. If the case suffers legal setbacks, the administration will face second-guessing from those who never wanted it in a civilian courtroom. And if lawmakers get upset about notorious terrorists being brought to their home regions, they may fight back against other parts of Obama's agenda.

The New York case may also force the court system to confront a host of difficult legal issues surrounding counter-terrorism programs begun after the 2001 attacks, including the harsh interrogation techniques once used on some of the suspects while in CIA custody. The most severe method - waterboarding, or simulated drowning - was used on Mohammed 183 times in 2003, before the practice was banned.

Holder will also announce that a major suspect in the bombing of the U.S.S. Cole, Abd al-Rahim al-Nashiri, will face justice before a military commission, as will a handful of other detainees to be identified at the same announcement, the official said.


My first question is why is KSM being tried in a civilian court while Abd al-Rahim an Nashiri is facing a military commission? I don't know enough about civilian versus military trials regarding these two men to offer any intelligent analysis, so I am waiting for Andy McCarthy to weigh in. As I'm sure many of you know, Andy McCarthy successfully prosecuted Sheik Omar Abdel Rahman and eleven others for the 1993 World Trade Center bombings. I'd like to hear if Andy thinks, as I do, that this a terrible idea to try KSM this way because it would put at risk so many national security secrets regarding how KSM was captured.
